Opening Probate and Conservatorship Accounts

California Probate has a bond it or block it rule in Probate and Conservatorship cases having to do with liquid assets of the estate.   Generally, liquid assets have to be bonded or blocked.  Bonding or blocking an account protects the estate against malfeasance by the administrator or conservator.  Joint control accounts no longer work in California and should be avoided as it leaves the assets of the estate in the hands of someone who is not appointed as the executor or conservator.

Opening an account as an executor:

Many clients ask us how to open an account when they are appointed as an executor.

Documents you need:

  1.  Certified Letters Testamentary or Letters of Administration.
  2.  A Certified Death Certificate.
  3.  Some banks will ask you for a Certified Order for Probate.
  4. An instruction letter re title on the account.
  5.  An EIN number, being the tax identification number for the estate.
  6. The format for taking title to the probate account is as follows:  Jane Doe, Executor/Admin of the Estate of John Doe.

Opening a conservatorship account in Los Angeles:

If you have been appointed as a conservator of an estate and need to open an account, you will need the following documents:

  1.  Certified Letters of Conservatorship.
  2.  Some banks will ask you for a Certified Conservatorship Order Appointing Probate Conservator.
  3.  An instruction letter re title on the account.
  4.  The social security number of the conservatee or an EIN.
  5.  Take title as follows: ] Name of the Conservator of Estate], as Conservator of the Estate of [Name of the Conservatee]
